Legal Issues

Can you think of some legal issues that would need to be considered in the pre-production stage of making a product?

Requirement by law.
Copyright- Brands/Music
Consequences - Fine, Court Procedure.
Reputation of both the company and product.
Consent of models- using the photographs. (Release & Consent form)
To film in different locations (location Permission Form)
Health & Safety Act.
Location Recce - Making sure the location is safe to work in.
Privacy, keeping peoples personal information safe.
Data Protection Act.
Discrimination.
Trademarks.

Freedom of Information.
Intellectual Property Rights.
Data Protection Act
Copyright, Design & Patents Act 1988
Libel
Slander


TEAM 1 - Copyright
1) Definition of what it means. producers cover anything they've created and what they own.
2) Three reasons why it is important - allows rights for recognition, helps create new products.
3) What are the consequences of not adhering to this law? Can be taken to court, fine/prison.
4) Find an example of where this legal issue was breached. ice ice baby & Under Pressure.
5) How does this law effect pre-production of a media product?

TEAM 2 - Data Protection Act
1) Definition of what it means. something to protect personal information
2) Three reasons why it is important - only allows certain people to access your information, keeps privacy and no information being used.
3) What are the consequences of not adhering to this law? Criminal conviction, Court or a Fine.
4) Find an example of where this legal issue was breached. Carphone Warehouse fined $400,000
5) How does this law effect pre-production of a media product? Making sure all the staff and customers details are kept safe.

TEAM 3 - Intellectual Property Rights.
1) Definition of what it means. Protection granted to the writers (copyright, trademarks etc)
2) Three reasons why it is important - prevents competitors using your idea without consent.
3) What are the consequences of not adhering to this law? fines up to millions if not a prison sentence
4) Find an example of where this legal issue was breached. Obama and Shepard Fairey.
5) How does this law effect pre-production of a media product? Being careful with any old photos or copyrighted music.

TEAM 4 - Freedom of Information
1) Definition of what it means - Gives general access of information held by public authorities.
2) Three reasons why it is important -
3) What are the consequences of not adhering to this law? fined, imprisonment, loss of productivity.
4) Find an example of where this legal issue was breached. The council on 2000 by failing to provide details.
5) How does this law effect pre-production of a media product?

TEAM 5 -Libel & Slander
1)Definition of what it means - Something that is falsely said/written that could danger someone's career
2) Three reasons why it is important
No ones career is put at risk
No ones reputation is harmed
Nothing is said without proof that could stop someone else's career instantly.
3) What are the consequences of not adhering to this law? Can be taken to court or fined through the business
4) Find an example of where this legal issue was breached. 
5) How does this law effect pre-production of a media product? Having to make sure no one makes false accusations to delay the release date on a product.
